A MEASURE RE‐AUTHORIZING AND EXTENDING THE TRANSACTIONS AND USE TAX (A SALES TAX) FOR GENERAL PURPOSES TO BE ADMINISTERED BY THE STATE BOARD OF EQUALIZATION

WHEREAS, this Council previously has, as directed and allowed by law, by

Resolution No. 2016-06, passed and adopted on May 24, 2016, called a General Municipal Election, for election of Mayor and Council Members, to be held on November 8, 2016, and has requested the County of Monterey to provide for consolidation of said election with the statewide election to be held on the same day; and

WHEREAS, this Council has determined that the City of Del Rey Oaks should re-authorize and extend the transactions and use tax (i.e., a sales tax) in the amount of one percent (1%), all proceeds from said tax to be utilized for general governmental purposes; and

WHEREAS, as required by law, this Council desires to submit, at the November 8, 2016, General Municipal Election, to the qualified electors in the City the question whether said transactions and use (sales) tax should be approved;

NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Del Rey Oaks, as follows:

1. At the aforesaid General Municipal Election the question to re-authorize and extend the aforedescribed transactions and use (sales) tax shall be submitted to the qualified electors of the City of Del Rey Oaks.

2. The aforesaid question shall be printed in the ballots used at said election in substantially the following form: “Shall an existing sales tax rate of one percent (1%), be extended for a period of not more than five (5) years, unless terminated sooner by the City Council, be adopted by the City of Del Rey Oaks, the proceeds of said tax to be utilized for general governmental purposes? Yes______ No_______”

3. As the ballot measure directed and described herein deals with a general tax, the measure shall pass if a majority of those casting a vote on the measure vote “yes.”

4. The City Clerk is ordered and directed to cause (a) the ordinance, set out below, embodying the proposed tax, and (b) the notice of election to be published in accordance with the provisions of the California Elections Code. The required publication shall be in substantially the following form, to wit:

AN ORDINANCE OF THE CITY OF DEL REY OAKS AMENDING ORDINANCE NO. 261 RELATING TO RE‐AUTHORIZING AND EXTENDING THE TRANSACTIONS AND USE TAX (A SALES TAX) FOR GENERAL PURPOSES TO BE ADMINISTERED BY THE STATE BOARD OF EQUALIZATION

WHEREAS, pursuant to California Revenue and Taxation Code Section 7285.9 the City of Del Rey Oaks (the “City”) has the authority to levy a Transactions and Use Tax for general purposes; and

WHEREAS, a majority of the voters of the City approved a one percent (1%) Transactions and Use Tax at an election held on November 7, 2006; and

WHEREAS, the City’s Transactions and Use Tax Ordinance is set out in Ordinance No. 261; and

WHEREAS, Section 3 of Ordinance No. 261 sets forth an “Expiration Date” of five (5) years from the operative date of the ordinance or at any sooner date as determined by subsequent ordinance of the City; and

WHEREAS, an extension or re‐authorization of the City’s Transaction and Use Tax will be submitted to the voters to extend the “Expiration Date” by an additional five (5) years to March 31, 2022 which will bring in approximately $300,000 annually in revenue to the City.

NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF DEL REY OAKS DOES HEREBY ORDAIN AS FOLLOWS:

SECTION 1. The definition of “Expiration Date” in Section 3 of Ordinance No. 261 is hereby amended to read as follows:

Section 3. EXPIRATION DATE. The authority to levy the tax imposed by this ordinance shall expire and sunset on March 31, 2022 and as of that date this ordinance is repealed unless an extension or re‐ authorization of this ordinance is approved by the voters of the City at an election called for that purpose; and which will bring in approximately $300,000 annually in revenue to the City.

SECTION 2. This Ordinance shall be submitted to the voters at an election to be held on November 8, 2016. Upon approval by a majority of the voters of the City voting on this Ordinance, the Transactions and Use Tax set forth in City of Del Rey Oaks Ordinance No. 261 shall be re‐authorized and extended through and including March 31, 2022.
