On September 14, 2015, the City Council adopted Ordinance No. 641 for the Homes at Deer Hill Project, located at 3312 and 3233 Deer Hill Road in the City of Lafayette. The Homes at Deer Hill Project includes 44 single-family homes and 11 acres of community park facilities. The Homes at Deer Hill Project was proposed as an alternative to the Terraces of Lafayette Apartment Project, a project previously submitted for the property that consists of 315 moderate­ income apartments in 14 buildings. Review for the Terraces of Lafayette Apartment Project was suspended while the City considered the Homes at Deer Hill Project.


In compliance with the California Elections Code, the City Clerk received a petition for a referendum on the legislative acts contained in Ordinance No. 641 and determined that the referendum petition contained sufficient signatures to qualify for the ballot. Ordinance No. 641 approves the following legislative actions: a zoning amendment to re-zone the property from Administrative Professional Office (35 units/acre) to Single Family Residential District-20 (2 units/acre) and to Planned Unit Development to provide 44 single-family homes; and a development agreement to provide an all-weather multi-use athletic field, dog park, toddler playground, multi-use trail and parking on 11 acres of parkland.


Ordinance No. 641 is suspended through the referendum process as required by the Elections Code. Ordinance No. 641 is the subject of Measure L.


A "yes" vote on Measure L will approve Ordinance No. 641 and the Homes at Deer Hill Project.


A "no" vote on Measure L will not a pprove Ordinance No. 641 and void the City Council's approval of the Homes at Deer Hill Project, and the property owner can request that the City restart processing the Terraces of Lafayette Apartment Project.


Measure L requires simple majority approval of the voters to pass.


If a majority of the voters voting on Measure L vote no, the City Council cannot approve a project substantially similar to the Homes at Deer Hill Project on the property for a period of one year.
